Fargo Vintage & Design – TERMS OF USE FOR SELLERS AND BUYERS
These Terms of Use apply to the use of the online store (“Online Store”) and to the relationship between the Online Store and its customers (“Buyer”) when the Buyer purchases Products from the Online Store.
By using the Online Store or purchasing Products from the Online Store, the User accepts these Terms of Use and agrees to comply with them. The User must review these Terms of Use before using the Online Store or ordering Products from the Online Store.
These Terms of Use, together with the Buyer’s order for Products placed in the Online Store (“Order”), constitute a binding agreement between the Buyer and Fargo Vintage & Design regarding the sale and purchase of Products. These Terms of Use also apply to the use of the Online Store.
The user confirms that they have the right to register with the Online Store on behalf of the entity in question. To purchase products from the Online Store, individual customers must be of legal age and have full legal capacity.

PURCHASING PRODUCTS FROM THE ONLINE STORE
Placing an Order
Once placed, an Order is binding on the Buyer. Information regarding the Product being ordered is available in the Online Store before the Order is placed.
When ordering Products from the Online Store, a binding agreement between the Buyer and Fargo Vintage & Design is formed either when a written order confirmation is sent to the Buyer via email, confirming the Product’s availability and other details regarding the Product, or at the time of delivery of the Products.
Payment for the Products is due at the time the Order is placed, either through the Online Store or at the location specified on-site.
Prices
The prices of the Products listed in the Online Store are valid until further notice. The prices of the Products listed in the Online Store include value-added tax in accordance with Finnish law.
Fargo Vintage & Design reserves the right to change the prices of the Products listed in the online store at any time and to correct any errors in the listed prices. The price displayed in the online store at the time of the order always applies to the Buyer’s Order.
Product Information
Product availability information, delivery times, restrictions on the use of gift cards, and other preliminary information are available in the Online Store before placing an Order. Orders are subject to the Buyer’s right to cancel a distance sale in accordance with consumer protection legislation, as specified in these terms and conditions.
Fargo Vintage & Design does not guarantee the availability of Products sold in the Online Store. If a Product is unavailable after an Order is placed, we will notify the Buyer by email as soon as possible. In such cases, the Buyer may either order an alternative Product or cancel the Order at no cost. Fargo Vintage & Design reserves the right to change the Products offered in the Online Store at any time without prior notice.
Payment
The Buyer shall pay for Products ordered from the Online Store using the payment methods offered by Fargo Vintage & Design in the Online Store at any given time. When the Buyer pays using a credit card payment option offered by the Online Store, the Buyer agrees to the terms and conditions found here.
USING THE ONLINE STORE
The user is responsible for ensuring that the information they provide is accurate and up-to-date.
Fargo Vintage & Design publishes all necessary information about the Products in the Online Store in accordance with applicable law, including the advance information regarding distance sales required by the Consumer Protection Act, to the extent that the information required by law is not provided in these Terms of Use. Fargo Vintage & Design is responsible for the accuracy and timeliness of the information it publishes.
The Online Store and its content (including images, text, service and product information, trademarks, videos, logos, and tables) is the property of Fargo Vintage & Design or its partners, protected by copyright and other intellectual property rights, and unauthorized use or copying is prohibited.
The User may not use the Online Store in violation of the law or good practice. The User may not modify or reproduce the Online Store or its content, or any part thereof.
The Online Store and its content are provided “as is.” It is possible that the Online Store or some of its features may not be available to the User without interruption. The operation of the Online Store and some of its features may depend, for example, on the devices and internet connections used by the User.
The User uses the Online Store at their own risk and is responsible for acquiring the devices, connections, and software necessary to use the Online Store, as well as for their operational condition, security, and any direct or indirect costs associated with them.
Fargo Vintage & Design reserves the right to modify or remove the Online Store’s functions and features, as well as the Products available in the Online Store. Fargo Vintage & Design is not responsible for storing any information added to the service by Users. The Online Store should not be used for storing or backing up any data.
COMPLAINTS
If a Product ordered from the Online Store does not match what was agreed upon, the Product is defective. The Buyer must report the defect directly to Fargo Vintage & Design.
Fargo Vintage & Design acknowledges that Products sold through the Online Store are sold in accordance with these Terms of Use and the product descriptions prepared by Fargo Vintage & Design. Fargo Vintage & Design is liable to the Buyer for defects in the Products offered through the Online Store in accordance with mandatory consumer protection laws.
All Fargo Vintage & Design products are vintage or used and exhibit natural wear and tear as well as a patina developed over time. Products are sold “as is,” so any signs of previous use observed on the products cannot be considered a defect. Please keep this in mind when ordering products. The defects mentioned in the product description are not exhaustive, and not all signs of use or defects may be visible in the product photos. CONSUMER’S STATUTORY RIGHT OF CANCELLATION
This section on the right of cancellation applies to consumer customers who have purchased Products from both the Online Store and the Retail Store.
As a consumer who has purchased Products, the Buyer has the right under consumer protection laws to cancel an Order placed through the Online Store or the Retail Store by notifying Fargo Vintage & Design within 14 days of placing the Order. Cancellation incurs no cost to the Buyer and does not require justification. Once the aforementioned period has expired, the Buyer no longer has the right to cancel.
The right to cancel does not apply to situations where the Product consists of a service whose performance begins before the end of the 14-day cancellation period. The right of cancellation also does not apply to situations where the Product consists of digital content and the electronic delivery of such digital content has begun within 14 days of placing the Order.
If the Buyer agrees on the timing of the performance of the service that is the Product or the delivery of digital content at the time of placing the Order, and the performance of the service or the delivery of the content begins within 14 days of placing the Order, the Buyer is deemed to have made an explicit request in accordance with the Consumer Protection Act and to have given consent to the performance of the service and the delivery of the content without the right of withdrawal.
Exercising the right of cancellation requires submitting a cancellation notice to Fargo Vintage & Design. The notice must clearly state the Buyer’s unambiguous and specific decision to cancel the Order in question.
The Buyer is deemed to have canceled the Order within the specified time limit when the Buyer sends the notice of cancellation to Fargo Vintage & Design before the cancellation period expires.
Consequences of Cancellation
If the Buyer cancels the Order in accordance with the Terms of Use, Fargo Vintage & Design will refund all payments collected from the Buyer without undue delay. The refund will be issued using the same payment method the Buyer originally used when placing the Order, unless otherwise expressly agreed upon with the Buyer. The Buyer will not be charged any fees for the refund.
LIMITATION OF LIABILITY
Fargo Vintage & Design is not liable for any indirect or consequential damages incurred by the Buyer as a result of using the Online Store or the Products.
The limitation of liability set forth in this section does not limit the Buyer’s statutory rights to compensation under mandatory consumer protection laws.
FORCE MAJEURE
Fargo Vintage & Design shall not be liable to the User for any damage resulting from force majeure or from delays caused by force majeure in fulfilling its obligations under the Terms of Use or the Order. Force majeure is defined as an unforeseeable event or change in circumstances that is caused by a factor beyond the control of Fargo Vintage & Design or outside its sphere of influence, and whose effects Fargo Vintage & Design is unable to avoid or overcome, or whose avoidance or overcoming would cause unreasonable inconvenience or costs. Examples of force majeure include natural disasters, fire, import and export restrictions, floods, acts of war, terrorist acts, disruption of telecommunications, labor disputes, revolution, pandemics, epidemics, actions by public authorities, court orders, or failure of Fargo Vintage & Design’s subcontractors to perform. Fargo Vintage & Design is obligated to notify the Buyer within a reasonable time of the occurrence of a force majeure event.
Fargo Vintage & Design is obligated to fulfill its obligations under the Terms of Use or the Order once the force majeure event has ceased. The parties may terminate the agreement without liability for damages or penalties for delay if the force majeure event has lasted for more than thirty (30) days.
ASSIGNMENT OF THE AGREEMENT
Fargo Vintage & Design has the right to assign this agreement and the rights and obligations under this agreement (including intellectual property rights and licenses) to a group company or as part of a sale of business or other corporate transaction.
CHANGES TO THE TERMS OF USE AND PRICES
Fargo Vintage & Design reserves the right to amend these Terms of Use by publishing the new Terms of Use in the Online Store and notifying registered Users of the changes via the email address provided to Fargo Vintage & Design.
The amended Terms of Use will take effect 30 days after the publication of the new Terms of Use.
The User accepts the amended Terms of Use by continuing to use the Online Store after the publication of the changes.
GOVERNING LAW AND DISPUTE RESOLUTION
These Terms of Use, as well as any disputes between Fargo Vintage & Design and the Buyer regarding the Order and the Agreement, shall be governed by Finnish law, excluding its conflict-of-laws provisions.
Fargo Vintage & Design will first attempt to resolve any disputes through negotiation. If a dispute regarding these Terms of Use and/or the Order cannot be resolved through negotiation, the consumer may refer the matter to the Consumer Disputes Board for resolution (www.kuluttajariita.fi). Before contacting the Consumer Disputes Board, the Buyer must contact the consumer advisory service at the nearest local register office (www.kuluttajaneuvonta.fi). A consumer may also submit a dispute related to the Terms of Use and/or the Order for resolution through the so-called online dispute resolution system maintained by the European Commission (http://ec.europa.eu/odr).
Disputes regarding the Terms of Use and/or the Order shall be finally resolved by the Helsinki District Court. However, a Buyer acting as a consumer may always file a lawsuit or appear as a defendant in the competent lower court of their place of residence.
